An appeals court panel said a Shawnee County District Court erred in suppressing all evidence obtained from a police search in a DUI case involving Jennifer Lee Neuman, of Rossville.
A Rossville city police officer stopped Neuman's car after he observed it crossing the fog line several times on US 24 Highway. A subsequent search of the car found open containers, indications of alcohol use supported by a field sobriety test, and the presence of drug paraphernalia. The state appealed the district court decision suppressing the evidence, and the appeals court ruled the officer had legal grounds to make the stop after observing a valid traffic violation. The case was remanded to Shawnee County
